1. General

a. Information on how to enter forms part of these conditions. Entry into the competition constitutes acceptance of these Terms and Conditions.

b. The Promoter is carsales.com Ltd, 449 Punt Road, Richmond, Victoria 3121 (ABN 91 074 444 018). Phone number (03) 9093 8600.

c. The term of this promotion is from 16 May 2022 at 4:00PM AEST to 6 June 2022 at 4:00PM AEST (“Promotional Period”).

d. For the purposes of these Terms and Conditions, carsales.com Ltd includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns.

e. All prize values are GST inclusive.

f. By entering into the competition, you will be deemed to have consented to the use of your personal information as outlined in clause 5 below.

2. Entry Requirements

a. Entry is open to all Australian residents who are 18 years or over. Entry is restricted to natural persons (not companies, trusts or organisations). Employees of the Promoter and their Immediate Family Members and agencies associated with this competition are ineligible to enter. “Immediate Family Members” means any of the following: spouse, ex-spouse, de-facto, ex-de-facto, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin (“Excluded Entrant”).

b. For the avoidance of doubt, entrants will not be eligible for entry after the end of the Promotional Period.

c. To enter the competition, entrants must, within the Promotional Period:

  • (i) view the Promoter’s Instagram post that invites entrants to tag a friend as part of this competition (Competition Post) ;
  • (ii) tag a friend’s Instagram handle in the comments section of the Competition Post using the entrant’s registered Instagram account;
  • (iii) follow both @bikesalescomau and @sherco_aust on Instagram within the Promotional Period, using the participant’s same registered Instagram account, and not have unfollowed either account by the time of the Prize draw (as detailed below); and
  • (iv) not be an Excluded Entrant

(“Eligible Entrants”).

d. Eligible entrants may enter multiple times. Each separate Instagram comment that satisfies clauses 2(c)(ii) and 2(c)(iii) and tags a different friend’s Instagram handled will be deemed to constitute an additional entry (subject to meeting the other requirements of Eligible Entrants).

3. Draws and Prizes

a. Each Eligible Entrant is entitled to enter multiple times based on the criteria set out above. The Promoter reserves the right to verify the eligibility of entrants at any time. The Promoter’s decision is final and no correspondence will be entered into with entrants.

b. From the total number of entries received, the first two randomly selected entries drawn who are Eligible Entrants (“Winner”) will receive a Prize as follows.

c. The first drawn Winner will win a 2022 Sherco EB16 Factory Balance Bike to the value of $999 (RRP). The second drawn Winner will receive a 2022 Sherco EB12 Balance Bike to the value of $649 (RRP) (“Prize”). There are two (2) Prizes to be given away in total, with a total retail value of $1,648 (incl. GST).

d. If either of the two randomly drawn entries are by an Excluded Entrant, the Promoter will redraw entries until an Eligible Entrant is drawn for each of the two prizes.

e. The electronic draws will take place at the premises of the Promoter being 449 Punt Road, Richmond VIC 3121 at 10:00AM AEDT on Tuesday 7 June 2022 unless precluded by COVID-19 restrictions, in which case the draw will be conducted remotely. This is a game of chance and skill plays no part.

f. Winners should seek their own independent financial advice if they are concerned about any financial or tax implications that may arise from the prize winnings.

g. Each Prize will be mailed by Mojo Motorcycles Pty Ltd to an Australian address nominated by each Winner. Postage times may be subject to COVID-19 related delays. Prizes will be provided directly by Mojo Motorcycles Pty Ltd and not by the Promoter.

h. The Prize is not exchangeable, transferrable or redeemable for cash. The prize may not be replaced if misused, lost, stolen or damaged. Winners are responsible for all use of the Prize.

i. If the Prize (or part of the Prize) is unavailable, the Promoter reserves the right to substitute the Prize (or part of the Prize) with a prize of equal value or specification, subject to any written directions given by the appropriate State or Territory Lottery Departments. No responsibility or liability is accepted for any variation in the value of the Prize. The Prize value is in Australian dollars.

j. The Promoter will use reasonable endeavours to contact Winners by Instagram by Monday 13th June 2022. Eligible Entrants who are not a Winner will not receive individual notification. If any Winner cannot be reached within 7 days of the draw via the Winner’s Instagram account, the Winner will be disqualified and the Prize made eligible for redraw under clause 4(l).

k. If for any reason a Winner does not take the Prize (or an element of a prize) by the time stipulated by the Promoter, or chooses not to participate in the competition or claim the Prize, then the Prize (or element thereof), will be forfeited.

l. The draws for any unclaimed or forfeited Prizes will take place at the premises of the Promoter being 449 Punt Road, Richmond VIC 3121 at 3:00PM (AEDT) on Tuesday 14 June 2022 unless precluded by COVID-19 restrictions, in which case the draw will be conducted remotely. The Promoter will attempt to contact the subsequent winner by email or phone call by 21 June 2022.

4. Entries

a. Each entrant’s information is used by the Promoter for the purpose of conducting the competition. The Promoter may disclose the information to Mojo Motorcycles Pty Ltd for the purpose of providing the Prize and other third parties, including but not limited to agents, contractors, service providers and, as required, to Australian regulatory authorities in relation to these purposes. Entry is conditional on providing this information. For further information refer to the Promoter’s Privacy Policy.

b. Entrants consent to the Promoter publishing their Instagram handle, full name and suburb on bikesales.com.au and Instagram in the event that they are a winner. Each entrant agrees to provide their full and suburb for this purpose.

c. Entrants should direct any request to opt out, access, update or correct information to the Promoter.

5. Warranties

a. The Promoter does not take any responsibility for any costs associated with entering and/or accessing this competition including and not limited to internet service provider costs.

b. If for any reason this competition is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the competition or to disqualify any individual who has tampered with the entry process.

c. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions subject to state legislation.

d. If the Promoter becomes aware that a prize winner is in breach of any warranty contained in these Terms and Conditions or made subsequently, the Promoter may deem that prize winner ineligible.

e. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) redemption of the Prize; and/or (g) any use or handling of the Prize.

6. Disputes

If you have a complaint regarding these Terms and Conditions, you may contact the Promoter by email at legal@carsales.com.au. The Promoter will endeavour to deal with it comprehensively and reach an outcome with which all parties are satisfied. If you remain unsatisfied, you may lodge a complaint with the relevant state regulatory body governing trade promotions.

7. Instagram

This competition is in no way sponsored, endorsed or administered by, or associated with Instagram. Each Eligible Entrant agrees to release Instagram from any liability associated with the competition.
